Section 498A under hindu marriage act. Can I file now?

11-Mar-2023 (In Divorce Law)
I got married in 2013 however My husband left me in 2015 and since than we were living separately. In between he never asked me to live with him. In 2017 my husband filed a divorce case 13(1) A and in mediation I was agreed to live with him but he did not agreed to live with me so mediation was not seattled. After last date of mediation he filed section 9. From 2015 to mediation he was not agreed to live with me and all of sudden he want me to live with him it is questionable? I feel he and his family planned a concpiracy against me.. I was about to file section 125 and 24 but before that I got section 9.. Now what can I do next? Can I file 498A now because they used to take all my salary and now I am bank defaulter because my husband taken 2 Pl on behalf of me

Maam,

498A is for the punishment for asking dowry, your case doesn't come within the purview of 498A and further an allegation assailing the grievances does not come within the purview of the said section. It is better that the said grievances should be redressed by either lodging an FIR or by doing civil recovery.

if he now agrees to live together then by mutual consent and along with an joint affidavit by both the concern party can be filed in family court or if the matter is pending before the high court that would be great if you apply again taking plea for mediation then the agreement will be on record for the future to for further details you can contact us along with the relevant documents.
