section 13 (1a) (ii) me 1 year decree ki date se count hoga ya judgem
29-May-2026 (In Divorce Law)
Hello Sir
Matrimonial case me section 9 ka judgement 4/2/2025 ko aya tha or uski decree 17/2/2025 ko bni thi. Decree pr judgment date 4/2/2025 h or decree date 17/2/2025 likhi h.
Q- ab pati ne section 13 (1a) (ii) me divorce 9/2/2026 ko dala hai. Kya 1 year complete ho gaya tha? Agar judgement ki date dekhe to time pr dala gaya hai agar decree date dekhe to 1 year se pehle dala gaya h. Kya judgement date mani jayegi ya decree date.
Plz sir Sahi answer dijiye
Thanks
Under Order 20 Rule 7 of CPC, the decree always bears the date of the judgment (4/2/2025), regardless of when it was prepared. Since 1 year was completed on 4/2/2026, the husband's petition filed on 9/2/2026 is legally valid and within time.
Dear Client,
For divorce u/s 13(1A)(ii) HMA after a Sec 9 decree, the 1-year period is calculated from the date of decree, not the date of judgment.
So 1 year completes on *17/02/2026.* Filing on 09/02/2026 is _premature by 8 days_. The other side can raise this as a preliminary objection. Courts follow _decree date_ because that is when the decree becomes enforceable, not the oral judgment date
Namaste.
Aapki decree date 17/2/2025 hai aur divorce 9/2/2026 ko file hua. Matlab 17/2/2025 se 9/2/2026 tak *1 saal poora nahi hua hai*. 8 din kam pad rahe hain. Is ground par pati ki petition maintainable nahi hogi aur preliminary stage par hi dismiss ho sakti hai. dhanyvad
Aap Court me ye objection jaroor uthayein. Detail discussion ke liye consultation book kar sakte hain.
Section 13(1A)(ii) Hindu Marriage Act ke anusaar divorce tab file kiya ja sakta hai jab Section 9 HMA ki decree ke pass hone ke baad ek varsh ya usse adhik avadhi tak pati-patni ne punah saath rehna (restitution of conjugal rights) shuru na kiya ho.
Aapke dwara batayi gayi tithiyan is prakar hain:
* Judgment pronounced on 04 February 2025
* Decree drawn/prepared on 17 February 2025
* Divorce petition filed on 09 February 2026
Mukhya prashn yeh hai ki ek varsh ki ganana 04 February 2025 se hogi ya 17 February 2025 se.
Section 13(1A)(ii) mein shabd prayog hai “after the passing of a decree”. Isliye samanya niyam ke anusaar decree ki tithi adhik mahatvapurna mani jati hai. Agar 17 February 2025 ko decree ki legal date mana jaye, to ek varsh 17 February 2026 ko poora hota. Is sthiti mein 09 February 2026 ko dakhil ki gayi divorce petition lagbhag 8 din pehle dakhil mani jayegi.
Haan, pati yeh tark rakh sakta hai ki judgment 04 February 2025 ko sunaya gaya tha aur decree usi judgment ka formal consequence thi. Is adhar par vah kahega ki 04 February 2026 ko ek saal poora ho gaya tha aur 09 February 2026 ki petition samay ke andar hai. Lekin Section 13(1A)(ii) ki bhasha dekhte hue adhik majboot kanooni drishtikon yeh hai ki decree ke pass hone ki tithi dekhi jaye.
Isliye prima facie aur kanooni roop se adhik sambhavit rai yeh hai ki yadi decree ki operative date 17 February 2025 hai, to 09 February 2026 ko dakhil divorce petition ek varsh poora hone se pehle dakhil ki gayi pratit hoti hai.
Final opinion dene ke liye judgment aur decree ki certified copies dekhna avashyak hoga, kyunki kai baar decree par likhi tithi aur decree ke legal effect ki tithi alag prashn utpann kar sakti hai.
