Q: section 13 (1a) (ii) me 1 year decree ki date se count hoga ya judgem

Hello Sir Matrimonial case me section 9 ka judgement 4/2/2025 ko aya tha or uski decree 17/2/2025 ko bni thi. Decree pr judgment date 4/2/2025 h or decree date 17/2/2025 likhi h. Q- ab pati ne section 13 (1a) (ii) me divorce 9/2/2026 ko dala hai. Kya 1 year complete ho gaya tha? Agar judgement ki date dekhe to time pr dala gaya hai agar decree date dekhe to 1 year se pehle dala gaya h. Kya judgement date mani jayegi ya decree date. Plz sir Sahi answer dijiye Thanks

Advocate Ankit Raj answered
Dear Client, For divorce u/s 13(1A)(ii) HMA after a Sec 9 decree, the 1-year period is calculated from the date of decree, not the date of judgment. So 1 year completes on *17/02/2026.* Filing on 09/02/2026 is _premature by 8 days_. The other side can raise this as a preliminary objection. Courts follow _decree date_ because that is when the decree becomes enforceable, not the oral judgment date

Q: After divorce defamation activity

Usne logo ko mere bare mai galat bata rakha h, kya mai un logo ko kuch proof (Chat or recording) dikha kr sach bata sakta hu ki mai galat nahi tha bo galat thi ? kya esa krne se mere upar defamation case ho sakta hai ?kiyuki log mujhe galat smjh rahe h to mujhe apni safai deni h unko or sach batana h, ki usne he galat kia tha mere sath na ki maine with proof.

Advocate Ankit Raj answered
Dear Client, Yes, you can show Chat/Recording as proof to friends/family to clear your name, but do it carefully. If you share private chats/recordings _publicly on social media_ or send to third parties without consent, the other side can file defamation u/s 356 BNS or a privacy case. *Safer way:* 1. If this is during divorce, file these chats as evidence in Family Court through your lawyer. Court proceedings have legal protection. 2. If people are asking you, give a brief written clarification + offer to show proof _in private_, don’t mass forward. 3. If the other side is defaming you falsely, you can send a Legal Notice for Defamation + file complaint. Truth + Good faith is a defense in defamation, but recording laws in India require consent. Don’t post it online without legal advice.
