Rights of wife after divorce in respect to money

My mom is 49 yrs.old now and I have grown up into a 21 yr old girl. Still my dad has not stopped fighting and raising hand on my mom. He intentionally irritates my mom and abuses her and now that she has started giving a reply coz she has self respect too and can't bear my father's nonsense anymore, he calls in the middle of the night continuously until we don't pick up the phone to hear his black mails which are like - ' goli maardunga, Teri maa ko kaatdunga, etc. A language which nobody can take on and especially when you are no wrong , this is where my dad's who get hurt and he starts abusing vulgarly and starts shouting like hell. The situation has gone to an intolerance that we pray wishing when will my dad die. He has not let us grown happily , he has put the bricks of favours on her head . My mom dad will be divorced . So want to know what rights she has in subject of money? And what are mine?

You should file a court case for Grant of maintenance and also a case under domestic violence act. You can also give a written complaint to women cell. Firtly you should start from by giving a complaint to women cell.

It is really sad part of life. Children suffers a lot in this. But at the end of day you need peace of mind.
So your mother is entitled for share in the property as well as maintenance per month. Lot more. You pls call or visit some day. I can explain you in details.

First your mom should file FIR against your father and side by side maintenance petition under 125 crpc ..You mother is entitled for maintenance for whole of her life and you are entitled untill you are married!!

your mother and you both will get maintenance under various provisions of law. This maintenance can be granted even if your mother lives seprately without divorce. In case she want divorce both of your are entitled for maintenance by your father. Maintenance in legal terms means the money that the man has to pay to his wife or children whatever the case may be. You would have equal rights as per succession Act, even you mother also have right up-to 50% in your father property. If your mother wants to divorce then she may take buy before that your mother should file domestic violence complnait against your father. She may also file maintenance order from court which she will get through out her life even after the divorce.. For more info you may fix appointment and meet me.
