Revoke Visitation rights for Husband
18-Dec-2023 (In Divorce Law)
I'm a mother to an 8-year old girl. My husband and I have been married for 9 years, out of which we are living separately for 3 years. As I did not want to separate my daughter from her father, I had agreed to give him visitation rights in exchange for paying her school fees and maintenance. However, in the past few months, he has been filling her head with unwanted things and he's causing rifts between me and my daughter. After speaking with him multiple times as to not this, I got really frustrated and told him that he can leave and not come to meet his daughter anymore. I also told him that I do not need his money and that I will take care of my daughter from now on.
My concern is, if I go to apply for divorce now, he will ask for visitation rights. However, I do not want to provide that to him. Can I revoke his visitation rights in exchange for not requesting maintenance for the child? I will take care of my child by myself.
Dear Madam,
Your proposal to give up maintenance in lieu of visitation rights in favour of your husband is appreciable. You may get issue such legal notice and he may come for compromise otherwise you may file a maintenance case for yourself and your child. You may get register MoU or enter into compromise before the Court as proposed.
Respected
As you infomred you are proceeding wiht the divorce, in that he may sought for vistation right also sinve both of you get equal right over the child. As you infomred that the child is at 8 years and it is left to you kid to visit his father or not. Even the daughter can also refused to visit him if she want and then he cannot force of take legal action for visitation. No need of revaking his vistation right in echange for maintenance. Let the child only refuse to go with him. Then he wont get right or his right will be stopped since no one have the right to visit his child with force full method. Nothing to worry. If ok You can contact me via Law Rato.
Yes it is clear case for you. But only thing that you have to substantially prove the case that the husband is having bad vices and have been acting weird with your DAUGHTER. As such your daughter is also mentally suffering a lot.
Meanwhile, visitation rights will be suspended by the court by the grounds provided by you. And you can file divorce by adding those grounds too.
