At councelling stage for non appearence of 2 hrgs, me {Respondent } is set exparte , stage is Petitioner (wife) exparte evidence. hence i filed set aside petition. Yesterday there was hearing ( check and call on), Lawyer didn't come & I was marked absent though i appeared & they Returned my set aside [exparte order] petition u/0 9 rule 7 for 2 mistakes of date & cause title and time given is 1 month and next hrg. is on 20 Jan.2019 .
1.i have doubt that whether they have taken her evidence and hiding.
2.But Yesterday's court dairy and e-court record is "Respondent absent and set aside petition returned
3. Family court is vacant and addl. family court is in-charge judge.
4. How quick i have to resubmit the set aside petition after making corrections.
5. because wife side want order badly , since court is vacant since 6 months & Judge not appointed.
6. now where i should be careful and how to stop exparte order

The order of exparte shall be set aside under sec 28(2) of CRP and sec 151 of CPC. An affidavit and petition has to be filed. If they returned for making corrections that can be made and to be filed immediately. because this person is urgent one
