Regarding Maintenance after divorce and iddat period

My cousin sister (Muslim) got divorced after 12 years of marriage and living within a worst condition and her iddat is about to be finished on 5 June, got one time settlement amount ( Dowry Money which was given) i.e. 5 Lakh rupees after mutual extra judicial divorce on stamp paper.Can she claim maintenance under CRPC 125 after iddat period.She has a daughter of 11 year old, and his ex husband is not giving maintenance to his daughter, who is living with her and her daughter doesn't intend to go to his father's home because of ill treatment in the past.Tell me what to do next. I'll be thankful to you.

Mehar is an amount which should given after the merriage and at the time of the merriage so there are so many cases when court decide that mehar is not a maintenance amount it is a liability of the husband. In your case your sister can file a maintenance and child maintenance suite in the family court. for more details i will contact you

Hello... She can claim for maintenance and even the daughter can claim maintenance from her father...So they both can claim maintenance... She can either claim under Muslim Personal Law or under Sec 125 Cr.P.C... Just file for maintenance... For more information call/text me... Thank You...

Hello..Yes she can claim maintenance from her husband after iddat period also...even her daughter also can claim maintenance from her father...So both are eligible to get maintenance...But the amount will be decided as per the earning of the husband...And will also depend on whether wife is earning or not... She can go for filing for maintenance in the Court... For more information call/text me... Thank You...
