Reg clarity on maintenance in event of divorce
27-Jan-2023 (In Divorce Law)
My husband and I want to separate . My daughter is 4.6 yrs and is not aware of this. I was working , presently quit working because of stress. My husband constantly keeps threatening me telling that I will not give you any money for you. I may give something for the child but not you. He says im educated, so I should fend for myself. Can you please let me know if and how much im eligible for ? Does working or not working matter for a woman for compensation ? Please help.
if you are working and the income which you are earning is sufficient to maintain yourself in the same standard of living which you are enjoying then you are not eligible for maintenance, but if your income is lower then your husband and he is enjoying better standard of living then even if you are working you will be eligible for maintenance, regarding child both parents are responsible if both are earning, but it is better you file a case for maintenance for yourself and your child, there will be no harm even if your personal claim for maintenance is rejected on basis that you are capable to maintain yourself out of your salary or earnings, but if your husband is enjoying higher standard of living then you will get maintenance even if you are working or non working.
