RCR counter not sent by my advocate
18-Oct-2024 (In Divorce Law)
How to deal with my advocate delaying legal proceedings. Counter was not sent for RCR lawyer notice sent by spouse inspite of reminding several times. Due to which now I got a court notice from spouse to attend court for MC under section 9
As the party who filed for Restitution of Conjugal Rights (RCR), it's important to take swift action:
1. Address Advocate Delays: Contact your advocate immediately to resolve the delay in filing your response. Ensure they submit the counter promptly to avoid weakening your case.
2. Attend Court for Section 9: Be sure to attend the court proceedings regarding the Maintenance Case (MC) under Section 9 and ensure your advocate is prepared.
3. Consider Changing Advocates: If delays continue, consider changing your advocate to ensure proper handling of your case.
4. Prepare for Maintenance Case: Work with your advocate to prepare a defense if you believe the maintenance demand is unjust.
Taking these steps will help you stay on top of your case and protect your interests.
Dear Sir,
You can engage another advocate if your previous advocate not ready to co ordinate with you. In the meanwhile attend the court and get copy of such RCR and suitably file your reply otherwise ex-parte decree maybe passed in favour of your wife. Get the services of senior advocate practicing before family courts.
