Q: Do I have a case against the police?

I had filed a complaint on 18/07/2023 at Hulimavu Police Station, Bengaluru, regarding a money scam case that occurred on the previous day. I had registered with the Cybercrime division as well. The money that I'm supposed to receive is in holding since months. But the officer in the IT Dept keeps making excuses that he's busy and that he has done his part and that he'll call if any update. Never called. Do I have any options, legally speaking of course? Because I fear I'll never get my money.

File a Complaint to Senior Officials: Escalate the matter by submitting a detailed written complaint to the Deputy Commissioner of Police (DCP) or the Commissioner of Police, highlighting the inaction of the IT department officer. File an RTI for Case Status: You can file a Right to Information (RTI) request specifically asking for updates on the investigation, the steps taken so far, and any reasons for the delay. This will compel them to provide a formal response.3. File a Criminal Writ Petition: If the police fail to take further action, you can file a writ petition under Article 226 of the Constitution in the High Court. The court can issue directions to the police to take appropriate action in your case and ensure progress in recovering your money.These legal measures should push the authorities to act on your complaint.



Q: RCR counter not sent by my advocate

How to deal with my advocate delaying legal proceedings. Counter was not sent for RCR lawyer notice sent by spouse inspite of reminding several times. Due to which now I got a court notice from spouse to attend court for MC under section 9

Q: Neighbour dumping sand and construction material in front of my house

Hi,My neighbor started construction and, without my permission, dumped a large amount of sand and other construction materials in front of my house. I informed the engineer that I need to park my car there, but he ignored my request and proceeded with dumping the materials. I also spoke with the neighbor, who promised to clear it in a few days, but the situation has not improved. The dust from the materials is affecting my house, and parking my car has become difficult. What should I do now?

We will have to file a suit for an injunction seeking stay against the construction on the grounds of encroaching your space and affecting your right of fresh air and light. Further, an application for temporary injunction needs to be filled which shall be granted on the day of filing and admission of the injunction suit.



Q: What happen re encroachment of land even after execution and delivery

Our land was encroached few years ago by 3 person and we filed Original suit against them and confirmed decree in our name. After decree we filed execution for delivery of our land and court issued delivery warranty and we got delivery of land from court against encroacher. Now my question is in case if again that 3 encroacher or any other person again try and re encroach our land then what will be the legal route for us.

Q: Land acquired but not notified , can building be constructed ?

Hello sir Recently our land was acquired to ring road . But one of the survey numbers was not notified .When asked about the same they told it would be notified.If I construct any building will I be eligible for compensation since it wasn’t notified earlier.Thank you

This is a grey area. The Govt may tend to notify or denotify the land for the ring road. We will have to look into the concerned ring road project by applying for relevant information through RTI and do a complete legal verification.
