Question about court mediation process

27-May-2026 (In Divorce Law)
Hello, To request court mediation in divorce cases i, are both parties required to sign the request document or can only one side submit it? My existing lawyer mentioned that both parties will need to sign the document requesting mediation before submitting it. Also, mentioned that he has taken permission from court to start mediation process. Thanks

In divorce matters, mediation can be requested even by one party, and the court may refer the matter for mediation if it finds chances of settlement. Both parties’ signatures are generally needed only if it is a mutual consent/request document. I can help you understand the exact court procedure and review.

Court mediation ke liye ek party bhi application de sakti hai. Lekin effective mediation process me usually dono parties ki consent/signatures li jati hain. Court referral bhi possible hai as per the concerned provisions of law.

Either party may request mediation before the court. Usually, one application is sufficient, but if mediation is by consent, both parties may sign. Court referral order is generally required as per the concerned provisions of law

if your case is at primary stage then, court will initiate mandatory procedure for mediation. if that already opted and not settle, then you can also file formal application with request for mediation. court generally allow it with the willingness of other party also. if both parties agrees, then by filling mediation form, opportunity will be given to both parties

Dear Client, In divorce matters, mediation can be initiated either jointly by both parties or by one party through an application before the concerned court. However, if the mediation request is being filed voluntarily before institution/proceedings, signatures of both parties are generally preferred. If the matter is already pending before the court, one party may also request referral to mediation, subject to the court’s directions. Your advocate’s advice regarding obtaining court permission before starting mediation is legally appropriate. It is advisable to proceed through proper court procedure to avoid future objections.
