Query regarding matrimonial problems
31-Mar-2023 (In Divorce Law)
Me(38) and my wife(33) married in 2019 (hindu arranged). Since 1 year, she has been living with her parents after a bad quarrel (families also got involved). Now I wish to leave this marriage but she does not want to. There has been no communication between us since 7-8 months. Physical intimacy was always a problem and she is not interested in starting family. Priorities, values, thought processes are very divergent and I see no hope. Both are working professionals
1. Can she file a DV/dowry case against me/my family despite not living with me for last 12 months? (None of this happened, however few gifts were exchanged)
2. Is she entitled to alimony/maintanence (working@15-20 lpa)?
3. If she tries to forcefully live with me now, what options do I have?
If you don’t want to continue with the marriage then you can always file for divorce in the family court. If you file your divorce first then all the cases filed by your wife after that will be treated as a counter blast. She can file for DV but as said by you that she never cohabited with you then you can always put your points in written statements. That’s the matter of arguments before the judge. For more legal assistance I am just a call away.
First and forthmost we would advise your goodself to seek a consultation from an expert lawyer and start the initiation of filing the intallah peshbandi application with concerned police authourities enunciating the true narration of facts that leads to seperation and apprehending false litigations. Denial to make physical relations tantamount to cruelty and you can seek divorce in this ground. Yes she can file DV and 498A against you. If she is working and capable of earing she will not be entitled to maintenance however she might get something considering your standard of living.
