02-Nov-2024 (In Divorce Law)
Both parties are ready to file mutual divorce under section 13B. Should I mention old rejected case matter in this 13B case? Opposite side case under section 13 was rejected by court in 2021. Opposite party had taken all stridhan and settlement money and mentioned that in section 13 case and asked court to provide divorce. But court rejected. Now they have come for 13B. What should I do?

13 B is a mutual consent divorce. Both party should mutually agree for divorce without any terms and condition.
simply provide a reason like non compatibility of couple to live along. And any other settlement point if agreed. And file for divice no need to give any detail of prior case.

you should come court with clean hand.
if you must enumerate the old case regarding to section 13.
otherwise at later stage you can't claim of fruit of your previous proceedings.
new section 13 application can be filled after rejecting old application.
the condition is it must be on new ground.
