Property Purchased by Husband in the Case of Divorce

If the Real Estate Property (Home) has Purchased by Husband & in the Case of Divorce what are the rights of Wife on the Real Estate Property (Home)? Please advise

Any property is acquired during the marriage is considered jointly owned by both spouse regardless whose name is on title the court will be decided how much you take from this and other knowledge consult us

wife has no right in the property ownerd by husband in case of divorce but she can get residence order under domestic violence act and also the price of the house can be taken into consideration by court to determine the lifestyle which was enjoyed by wife earlier to determine maintenance amount

Any property purchased by Husband, has right of the wife over it. She can claim her right over the said property. Nature of the property does not create any bar on the right of the wife to claim at the time of divorce. For any further advice feel free to contact Thanks

Hello the right of wife is only maintenance she cannot claim the husband property. however if during purchase of property it can be established any share was given out of wife saving or stridhan as per Hindu marriage (?) , can we demanded back but not maintainable if source is not clear and evident. hope this will be of help

Divorce wife doesn’t have any rights on husband’s property at all ! Divorce wife can only file maintenance case until she doesn’t marry or under certain conditions she doesn’t get maintenance! However children will always have right over parents property
