Procedure to remarry without taking divorce under muslim law.

Greetings, I'm Abdullah from T.N, I got married Muslim woman back on 2013as per Islamic Shariah, due to the continues metal harassment of my wife and in laws, I filled a divorce case on last month. Now, can I marry someone, whereas my divorce case is ongoing in the family court - TamilNadu. Please clarify as per IPC will have any impact or problem on my divorce case as well is there any chance for them (my wife) to corner me if I married gain though I did not get divorce from her. Please advise me legally.

Don't worry. Your personal law allow you to get another one marriage if one wife lives and also not get divorce. You are not
guilty under Indian penal code because your personal law saves you if you have capability maintain two wives.

Please note that
- so Long you are a Muslim by birth
- and you have professed Islam as your religion
- and you have married a Muslim women whose again by birth professes Islamism
- and you have not exceeded 4 marriages
- and your subsequent marriage is not within the prohibitory relationships
- and you have married your Wife in front as per Islamic rights and rituals

You need not come to the court of law
Ipc doesn’t apply to you
You have the option of talaq

all Indian will attract to the ipc 494. the person cannot get remarriage until it comes to an order or decree of the court. the first wife may file criminal case before the criminal court. it is not advisable to remarry

It is absolutely an offence If you marry anybody during the subsistence of the first marriage. I definitely you will get into trouble under 494 off Indian penal code.
