Procedure to file for divorce from husband

What r the legal procedure for divorce when girl isliving in her in law house. She has two kids also.she is living in joint family.

For getting Divorce you have to live away from matrimonial house for one year. Meaning you have to show one year separate living. You can file Domestic violence against in laws if you're facing mental and physical harassment at the hands of husband and in laws.

Divorce can be obtained from spouse either on mutual consent basis or other grounds , such as cruelty etc.
Mutual Consent Divorce can be taken if both , husband and wife are mutually agreed for the divorce , not otherwise.

For taking divorce on other grounds, such as cruelty, one has to file a proper case, contest it ( has to produce evidence etc.) , and if court will find genuine reasons , than only divorce will be granted. If wife is living in in-laws place , this has no bar to file a case for divorce provided there are sufficient reasons to file a case and to get divorce. In India, divorce at the 'will' of one party is not available.

One can file for divorce only after proving that there has been no co-habitation between the parties for a period of 1 year prior to the filing of divorce. If the couple is living in the same household and one files for divorce it would lead to breach of trust. However, in such cases the party filing for divorce can mention in the petition that the parties have withdrawn from each other's lives and they are living in separate rooms and occupying separate areas of the premises without interfering in each other's lives in any manner.

Dear mam, since you have already completed one year of marriage, you and your husband can go for divorce mutually. Once we file a divorce by mutual consent court will give 6 months period for conciliation. after completion of six months, court will grant decree of divorce.

hi u could go for divorce by mutual consent or if he is not willing to divorce you, you could send a notice for divorce and subsequently you could file a regular divorce before the Family Court. Divorce by mutual consent can be procured quickly.
