My elder brother got married in 29th july 2017 and the marriage happend in Andhra Pradesh and we r staying in Bangalore now today date is 14th oct 2017 it not been even three months of their marriage and they r not at all happy daily fight and all, i need Information Reading filing a Divorce and how to proceed further...
You can file divorce petition. On the grounds of cruelty that you brother is facing and can file for divorce .... Tell your brother to collect as much as evidence against her wife to show her cruelty against your brother which helps for the case

You can file petition for divorce by mutual consent under section 13 B HM Act. Without waiting fr 6 months as per Hon SC ruling. .but the grounds fr divorce need to be strong enough so that relationship has strained to irretrivable stage and reunion is impossible. .the family court will decide BECAUSE THE DUTY OF FAMILY COURTS ARE FR TO SEE DISPUTING COUPLES REUNITE WHICH IS BASIS FR HAPPY FUTURE. .

they have to wait up to one year. Within one year of marriage they can not file divorce petition in any court. but they have liberty to live separate each other. better ask them to take counseling from competent person for their better understanding
