Procedure to file a petition for contested divorce

Divorce for Hindu couple. Husband wants to get divorced as he doesnt get along with wife (No compatibility). Wife always preferred to stay away from him at her parents house. They have no chemistry. No intimacy. Wife always refuses for physical relationship. After discussion wife too agreed on incompatibility and was ready to give divorce. She had left his house with all her stuff, but she got to know that he is moving on and dating other women. Now she is asking for alimony and back to his house and not leaving his house. She is not telling him any of her decision and he is stuck. What can he do in this situation. To move her out of house and make her file for divorce. Please suggest a way forward.

You can apply for a decree of divorce before the family court under section 13 of the Hindu marriage Act, on the grounds as may be applicable to your case. If you are able to prove the grounds, court will allow your petition.

You can file petition for divorce both or husband or wife district jurisdiction court
Court has order pass six months to eighteen months beetvin
Consent divorce petition is early pass order.
