Procedure to file a divorce, complainant is in UK
24-Aug-2023 (In Divorce Law)
Hi I am from uk and married an Indian man in April. Unfortunately the marriage isn't going to last on the grounds of unreasonable behaviour and quite possible adultery. How can arrange a divorce? I am in the uk Thank you
As you have not mentioned whether marriage was performed in India of U.K. or elsewhere, if it was in India and under Hindu marriage Act then no petition for divorce can be filed before completion of one year of the marriage which in your case would be April,2018. Better course would be to make him agree for mutual consent divorce which will take least time of 6 months to one year otherwise you can go for contested divorce. As you are in U.K.., case can be filed in India through an athorised person. For detail you may contact through this site.
Dear Client, you can file a divorce petition in India by giving a special power of attorney to someone in India. It can be anyone you trust, parents, friend etc. However, you can only file a divorce petition after one year has passed since your date of marriage.
Make sure if you are in UK the marriage must be dissolved according to hindu marriage act and both the larties consent must be received or else. Reach to your nearest district court or any court falling inside the jurisdiction of your matrimonial stay and seek for divorce under Hindu Marriage Act.
as per your query you certainly have certain grievances and concerns. you need to send the other party a legal notice after consulting a lawyer and thereafter if the other party still chooses not to respond or reply to your legal notice you are at liberty to file a case against him / her in the court of law.
Please provide further details as to where you lived after the marriage . It is important to establish where the matrimonial house was, if you have married under the Hindu Marriage Act.
Kindly provide details with regard to your citizenship, duration of marriage, place you resided after marriage , the period for which there has been no conjugal relations between you and your husband .
