Procedure of divorce where only one is indian citizen
03-Jun-2023 (In Divorce Law)
Hi sir actually I want to know the procedure of divorce in the case where wife is holding Nepali citizenship and husband is holding Indian citizenship
Dear,
Citizenship of the wife does not matter when filing for divorce. Religion of both the parties is important for initiating divorce proceedings. If you and your wife have married according to the Hindu rites and customs, file for divorce under Hindu Marriage Act and if both are Christians, under Indian Divorce Act and if both are of separate religions, under Special Marriage Act.
