Prejury against maintanance case u/s PWDA act for wife and daughter.

14-Jan-2023 (In Divorce Law)
I filed a DV case against my husband in 2015. In 2020 I obtained a favourable judgment and alimony of 12000 per month. However my husband objected this stating that I am working. He obtained TDS traces of IT from IT dept but no salary slips or confirmation from the employer. Reg my job. I did part time job for 2 yrs and one year I have a contractual role. I didnt disclose all these as it was not permanent roles. However, my husband initiated a prejury against me stating I lied to the court about my job. What shall I do? My case on domestic violence is proved beyond doubts and a series of incidents are recorded by police too. There is a case on violation of protection order is also running parellely in which judgment is pending. The case is infront of the same magistrate who pronounced the DV judgment. What shall I do? Please advise

In order to tender any kind of advice on given facts, one has to go through the content and statements given in the case in verbatim. Solution lies in the file. We can mince words and argue the matter successfully in the court. it will never be easy for him to prove perjury.

There are judgments of Supreme court which says that even though the wife is earning she can claim maintenance. Moreover you should not admit that you were doing a job. As long as you don’t admit, things won’t be deemed proved against you.
