In cases under Sec. 498A IPC, police usually issue a notice u/s 41A CrPC before any arrest. You are legally bound to cooperate, but you should not go alone. Immediately engage an advocate and appear before the police with anticipatory bail preparations. Do not ignore the notice—non-appearance may worsen matters. If threats are being made by your wife’s side, record and preserve evidence for your defence. Your safest legal remedy is to apply for anticipatory bail for you and your family members to avoid any risk of arrest, and let your advocate represent your medical/personal difficulties formally before the police.

hi it is better to appear and take notice and for your father and mother you could take the notice at later stage as they are not well and you could ask for more time from the court and proceed accordingly in the matter

If the police had threatened you, do not go alone to the police station. Under 498A IPC, police must serve a notice under Sec. 41A CrPC before arrest. Ask for a written notice. If they insist, go with a lawyer and witnesses. You can also apply for anticipatory bail in advance to stay protected from arrest. If there are threats from your wife and her family members, inform the SHO in writing and keep evidence.

This is a 498A IPC case (cruelty), which is a cognizable and non-bailable offence. You should not ignore the police call — cooperate and appear at the police station, preferably with a lawyer. Police usually issue a notice under Section 41A CrPC before arrest, and you can sign the notice and get station bail if given. For your safety, apply for anticipatory bail under Section 438 CrPC for yourself and all family members named in the FIR. This will protect you from arrest during investigation. Keep your Aadhaar and basic ID proofs ready when you go. If police are pressuring you or not following procedure, you can approach the SP/Commissioner or file a petition before the High Court for directions.
