Out Of Court Settlement

I need an advice on this case , its a divorce case and both parties have agreed for out of court settlement , But We were told after six months both the parties need to come to court to sign papers even after this settlement is done, but meanwhile if you wish one can get married again . and also I wanted to know once this settlement is done how soon can 2nd marriage be done . I wanted advice on how long does the procedure of out of court settlement take .

Regarding your query.

In this regard, when both parties are consenting to Divorce by Mutual Consent, you will have to appear before Court on the first date and file the first motion, the Court thereafter grants you a period of 6 months where you have to appear again and file the second motion.

Immediately after the second motion (6months) as soon as the Court has decreed the suit and granted 'Divorce' you may get married immediately thereafter without any problems.

The procedure of out of Court settlement can be done within 1 week's time provided both you and your wife are on the right mindset and are not seeking alimony or have pre-decided if payments are to be made or not.

To get a divorce by way of mutual consent, you need to file first motion as well as 2nd motion.
Further, you cannot marry right after first motion.
