Hi, my maintenance case is going on under crpc 125, where other party is not responding properly and try to linger around this case. I came across with a voice recording , where other party lawyer is suggesting them to make back dated affidavit and notary by doing fake sign. They are doing the same thing what should i do now and i want to complaint about this lawyer also.

You can wait for them to complete the same so that it can be said that an offence is committed Thereafter once they make the submissions in the court, apprise the court of the truth with proof and also file a case for perjury if need be.

If the other side is intentionally delaying the case and now, as you mentioned, there’s a voice recording of their lawyer suggesting to create a backdated affidavit with a fake signature and get it notarized — that’s a serious issue. Here’s what you can do: 1. Save the Recording: Make sure the voice recording is properly saved and backed up. This could be important evidence later. 2. Inform the Court: You can file an application before the judge in your CrPC 125 case, mentioning this misconduct and attach the transcript or details of the recording. The court can take this into consideration and even take action if they find it credible. 3. Bar Council Complaint: If you’re sure the advocate is involved in such unethical practices, you have the right to file a complaint with the Bar Council of the respective state. Such conduct is against the professional ethics of an advocate. 4. Police Complaint (if needed): Depending on the facts, if there’s a clear attempt of forgery or fraud, you can also approach the police with a written complaint. Let me know if you need help drafting any of these documents — happy to assist. Best, Sahil Gadhwal Advocate

This is obstruction of justice and punishable under IPC. The punishment under this can go upto 7 years as well as fine. We have expertise in handling such cases and we would be happy to help. A separate Complaint before the magistrate can be filed regarding this. Please feel free to reach out.
