Is it a mistake of the husband if he doesn't file for divorce before the maintenance order is given? In my case the judge openly told me during my cross examination to discuss and compromise and when that didn't happen, he told my lawyer to file cp. My lawyer said CP means divorce. I'm worried on what is happening.
Dear Sir,
Nobody can direct you what to do in your family matter. If you have confidence then you can file application for Restitution of Conjugal Rights. If you wish to break down the marriage permanently then only you can file Divorce case. In either case you are liable to pay monthly maintenance or one time compensation that is alimony to the wife depending upon the incomes of both the parties.
