On going 125 by wife argument stage
08-Mar-2025 (In Divorce Law)
As per law isn't oral argument mandatory? The family court judge asked only to submit written argument. Who should submit first; the petioner or the opponent as per law? Wife filed the case but judge asked my lawyer to submit first and allowed more time to her lawyer. So her lawyer has my argument copy now. Judgement day will come next week. What should I do now?
The first party filing files the plaint based on which WS is filed by the respondent. However during arguments stage the court has the discretion to call for written arguments. Do not worry. Once the written submissions are filed by both parties, your lawyer can make oral arguments backed with the info given in the written arguments made by the other party
