Notice not received as door locked

26-Dec-2023 (In Divorce Law)
I have put restitution case for which my husband nor his lawyer are appearing for court hearings. And I am trying to send DV notice, every time register post is returned saying door locked. (I am very sure this is done intentionally). What can be done in this situation?

Well, you can send a Legal Notice to your Husband by getting it published in two local newspapers. You can send Legal Notice to your Hubby via Email and WhatsApp as an alternative of pasting Legal Notice on his door.

Their are various ways/strategy have to used when notice was not received intentionally 1) Put one application before the court in which you mention that your notice is not received the respondent intentionally 2) In the same application .seek the court permission to send notice using email or any other means once court pass order or allow your application then send notice using email or any other means 3) after all your efforts to send notice are over. and then also notice will not be received then mention this thing to the court and request to the court to proceed your matter in ex-parte and take ex-parte order

Well, you can send Notice via Email and WhatsApp to your Husband and his lawyrer. Both the modes of sending notices have been legally recognised as valid by the Honourable Supreme Court of India as per the IT Act, 2000 and Indian Evidence Act, 1872.
