A Maintenance Case (MC) filed by a wife, usually under Section 125 of the CrPC (now corresponding sections of BNS) or personal laws, seeks financial support from her husband. A wife is entitled to maintenance if she is unable to maintain herself, often receiving roughly 20–35% of the husband’s net income. Indian Kanoon Indian Kanoon +4 Key Aspects of MC Case (Wife): Eligibility: The wife must prove she cannot support herself and the husband has sufficient income but neglects her. Exceptions: Maintenance can be denied if the wife is living in adultery, refuses to live with her husband without a sufficient reason, or if they are living separately by mutual consent. Interim Maintenance: Courts can award interim maintenance and litigation costs to ensure the wife can survive during the pendency of the case.

Sure, you have to file a case for claiming maintenance despite being a working woman. If your husband is neglecting to support you and your child, you can seek financial support under Section 125 CrPC(corresponding to section 144 of BNSS act); and also claim monetary relief under the Domestic Violence Act. Both you and your child the absolute rights to claim maintenance, and the court will consider whether your income is sufficient compared to your husband’s earning capacity and standard of living..
