Need to Understand before filing Divorce / Legal Notice

28-Sep-2026 (In Divorce Law)
I am married for 14 years now. I am a Christian. I have 13 years old son. From the beginning, spouse had anger issues. If he gets angry, he will use cuss words very badly. Recently, when I was scolding my son, for not studying, husband was ignoring me and supporting my son. I got irritated and shouted at him also. Still he was ignoring me. I said, let's separate if you are treating me like this, for which he said, do you think I will leave you alive, u r cheating on me etc. Then, he apologized.

Before you are separate once both of you talk to each other about the next steps. If it is not possible to reunite then you both decide about mutually separate. Before the separation think about the child because there are no serious issues between each other.

I understand your concern. Repeated use of abusive and insulting words, threats, and such behaviour over a long period can be serious in a marriage. Since you have been married for 14 years and have a 13-year-old son, it is better to first understand the complete circumstances before deciding about divorce. As you are a Christian, the applicable divorce law and the facts of your case should be examined properly. Please consult a family-law advocate and discuss the incidents, any messages or other evidence, and the safety of you and your child. If the threats continue or you feel unsafe, take appropriate safety measures immediately.

Dear Madam Divorce Grounds: Under the Indian Divorce Act, the persistent verbal abuse, false accusations, and life threat constitute strong legal grounds for divorce based on mental cruelty. Safety & Protection: You can immediately seek protection orders or file a complaint under the Protection of Women from Domestic Violence Act 2005 due to the explicit threat to your safety. Child Custody: Courts prioritize the child's welfare, and because your son is 13 years old, the family court will likely consider his personal preference. Financial Support: You are entitled to claim interim financial support for yourself and your son during litigation, as well as permanent alimony upon divorce.
