Need to have a divorce from my abusive husband.

03-Aug-2024 (In Divorce Law)

I am not happy in my marrige. My husband is abusive and violent. He manupulate me everytime. My mental health is not stable with him. His family is not supportive. We recently bought a house and I am paying the EMIs. He is not giving me money for daily basis. I am fed up. Its been more than 2 years now for our marriage. What can I do to get a divorce?

Well, you can file a case of Economic Cruelty, if he is not financially supporting you and if for all your finances, you are totally dependent upon him, but as you are paying the EMIs', this doesn't seem so. However still, you can file a Maintenance Petition under the Bhartiya Nagarik Suraksha Sanhita.

Hello madm firstly you can take a consultation with any good lawyer with regards to your issue and file a domestic violence case against your husband for maintenance then go and file divorce case before family court where you reside

You are supposed to file divorce based on cruelty along with domestic violence case. You can also ask for maintenance from him and get an order for him to pay emis. You will need evidence of violence and witnesses.
