Need second opinion on Domestic Violence case legal issues.

Before initiating case, i want to clarify about the legalities and formalities. Hindu but intercaste marriage. Seperated from march 2022, husband initiated divorce, i opposed. The case is dismissed due to his absence to the court. Reunion case initiated and its alive. Mc case in argument stage. We have daughter she is 7 years. His mother died in april and i went and did all the formalities. He spoke with me normally like reunion aftr that. He stayed with me one day aftr that. Asking divorce

Dear client if you have any Preserve any text messages, call logs, photos, or witness statements preserve the same for evidence to establishing her presence and their subsequent one-day stay together. Try to get a judicial order form the court in MC case... Need furthermore clarification or doubt please call me

From the facts stated, your husband's earlier divorce petition was dismissed for default due to his non-appearance. Since you have already filed a restitution of conjugal rights (reunion) petition and a maintenance (MC) case, both proceedings will continue on their own merits. If, after his mother's demise, he resumed cordial relations with you and stayed with you even for a day, that fact may be relevant depending on the grounds now taken for divorce and the evidence available. If he files a fresh divorce petition, you can contest it by placing all subsequent events before the Court. If both of you are willing, an amicable settlement or mutual consent divorce can also be explored. As you have a 7-year-old daughter, issues relating to her custody, visitation and maintenance should also be appropriately addressed. you have already filed case for reunion. let the case continue. if your husband wants divorce he has to reopen his case. since you have a daughter you. can claim maintenance from your husband. what case you want to intitiate mam?? while you are interested in reunion.
