Need Legal Counsel for SAHM Hindu Female

03-Feb-2026 (In Divorce Law)
My husband had unhoused our sons and me in June and sent a legal notice in August 2024. I hired a lawyer to help with the process. In December 2024 he pretended to reconcile as he didn't want to pay alimony. From March 2025 he resumed the physical emotional and financial abuse. He contacted my lawyer to pursue a divorce via mutual consent. I’ve been asking her to send a fee payment schedule and scope of work and start divorce proceedings. But she has been ignoring my messages and emails??!!

Since your advocate is not responding, kindly change counsel immediately. Send a written request to share complete case papers/file and drafts. Considering physical, emotional and financial abuse, proceedings under the DV Act can be initiated and reliefs like protection, residence and monetary support can be sought.

You are not bound to wait. You may change your lawyer for non-response, issue a notice, and proceed with contested divorce citing cruelty, abuse, desertion, and seek maintenance, residence and child reliefs under HMA, DV Act and CrPC 125.

Take these steps: Send the final written message today Start consulting another family law lawyer immediately Prepare to file DV + interim maintenance Do not commit to mutual consent under pressure Your safety, financial stability, and your children’s well-being come first , not his convenience and not a lawyer’s silence.
