Need legal advise Regarding Non-Maintenance of Interim Order

17-Dec-2025 (In Divorce Law)
In a maintenance case, interim order has been issued. An FIR has been registered and Chargesheet filed (including DP Act 3/4 and 3 others sections of BNS). All the accused got bailed from court with surety bond. Husband got stay from high court. If husband abscond from paying maintenance and dowry case, what would be the impact on other accused? What would be impact on maintenance case? Would court ask parents to pay the maintenance?

legal advice for your query regarding the maintenance and dowry case: The legal obligation to pay maintenance rests solely on the husband. The court cannot legally compel his parents to pay maintenance on his behalf. If the husband fails to pay maintenance, you should file an Execution Petition for the attachment of his property or the issuance of an arrest warrant. The criminal trial (under BNS and DP Act) against the other accused (parents/relatives) will continue independently. The husband’s absence will not stop the proceedings against them. If the husband absconds, the court may forfeit the surety bonds deposited for his bail, and the person who stood as his surety will be liable to pay that amount to the court.

court can not shift liability but court can issue warrant in case of default in payment of maintenance and if time period is more than one year for default then you can move an execution application and for more detail you can contact me there i can advise you all remedies available in law.

A DV case is entirely different from that of Maintenance case u,S144 and same is with the FIR case even if he's sought a relief from the high court in FIR case , he's not relieved from the maintenance or DV case in such a case ask the court to issue warrant against the husband court never orders parents to maintain the girl if she's is married to a person, the person is entirely responsible and entitled for maintaining the girl wedded

the husband absconds despite an interim maintenance order and pending dowry case, the legal impact is as follows: Impact on other accused (parents/relatives): Criminal liability is individual. Merely because the husband absconds, other accused will not automatically suffer punishment. However, if they are sureties for the husband, the court may forfeit the surety bond and initiate recovery proceedings against them. If evidence shows their active role, trial will continue independently against them. Effect on dowry/DP Act case: If the husband absconds, the court can issue NBW, proclamation under CrPC 82, and attachment under CrPC 83. Proceedings against co-accused may continue or be separated. Absconding weakens the husband’s defense and may lead to adverse inference. Impact on maintenance case: Maintenance is the personal liability of the husband. Non-payment can lead to arrears, execution, warrant, and even civil proceeding.

Husband absconding mainly prejudices his own case (bail cancellation, coercive recovery). Other accused are affected only if they breach bail or are sureties. Maintenance remains enforceable against the husband; parents are not ordinarily directed to pay.
