Q: Effective Date Of Divorce After
Hello respected advocates,I need guidance regarding my mother’s family pension eligibility as a divorced and dependent daughter of a deceased Civilian Defence Employee (Air Force Station Hindan, Ghaziabad). The key confusion is: divorce happened in 2006 (Muslim personal law), but decree confirming the same is dated 2021, after the pensioner’s death. My maternal grandfather Late Shri Mohd. Rafiq served as Watchman (Civilian Defence Employee) at Air Force Station Hindan, Ghaziabad (Pension No. 28W/463). He received pension from 2012 until his death in 2018. His wife (my Nani) passed away 3 months later. After that, my mother applied for family pension.Name: Smt. Shama Parveen (aka Meena Parveen in old records)Marriage: 13/10/2001Talaq: 12/02/2006 under Muslim Personal Law (Talaknama signed with witnesses)Since 2006, she lived with her parents and was financially dependent on themShe never remarriedShe remains unmarried and dependent now
Advocate Manish Mishra answered
Administrative Appeal: Submit a detailed representation to the Air Force Station Hindan or the relevant Pension Sanctioning Authority, attaching the 2006 Talaknama and the 2021 Decree to prove the continuity of her divorced status. If the department rejects the claim based on the decree date, the most effective remedy for a Civilian Defence Employee's dependent is to approach the CAT.
Q: Quashing of FIR in a criminal case against my ex-employer
My ex-employer had a legal case filed against it by its customer. My name has appeared in the FIR as I was representing that company. I have left the company 2 years back. However I have to take leave and keep going to the court for the hearing matters. My ex-company is not paying me any amount as a consideration for my time. Also i would like to get my name removed from the case as I'm no longer working there. What are the remedies available to me
Advocate Manish Mishra answered
Since you were merely an employee representing the company and have left the organization two years ago, you can approach the High Court to file a petition for Quashing of the FIR against you, provided there is no evidence of personal criminal intent or fraud on your part.Generally, in cases involving corporate disputes, an employee cannot be held personally liable for the company’s actions unless a specific role in the alleged crime is proven. If a chargesheet has already been filed, you can move a Discharge Application in the trial court, arguing that there is no sufficient ground to proceed against you individually. You should immediately collect your resignation and relieving letters to prove you were no longer with the company during the relevant period of the dispute (if applicable) and consult a lawyer to evaluate the merits of a Quashing Petition.
Q: Dowry and others case, name Discharge is main case
FIR has been registered on 2 Feb 2025, which included only husband name, chargesheet has been filed, which extended 6 relatives names. We all are about to get the bail.Help need regarding name discharging application and whole trial. Please tell me: What is probability of name Discharge of distant relatives before trial? Probability of discharging name of my parents? How much time we can get in framing charges? If you are in ghaziabad, please leave your contact no.
Advocate Manish Mishra answered
If the charge sheet does not contain any specific allegations or concrete evidence against distant relatives, there is a high probability that their names will be removed from the case before the trial begins. According to several Supreme Court judgments, implicating relatives without a solid basis is legally incorrect. If your parents live separately or there is no direct evidence against them, there are strong legal grounds for them to be discharged as well. The process of obtaining bail and hearing the discharge application can typically take 3 to 6 months. This depends on the court proceedings and the arguments presented by the lawyers.Difference between FIR and Charge Sheet: It is a common practice that during the police investigation, the police may add the names of other people besides those mentioned in the FIR to the charge sheet, but it is mandatory to prove their involvement in court. You should immediately file a discharge application through an experienced lawyer under Section 250 BNSS (formerly Section 227 CrPC). This application should clearly state that the relatives have no role in this case.
Q: Sexual harassment, physical, verbal , financial, emotional abuse
Advocate Manish Mishra answered
Q: Name discharge of Accused/Relatives
FIR has been filed against husband and his relative (498-A, 323 IPC, 504 IPC, DP Act 3/4) all the accused have bail from district court. Name dicharge appliction has been filed in session/family court but it's been rejected. Can we go against it direcly in Allhabad High Court? ORShould I file a revision petition in session court? What are the duration for verdict in discharge case in High Court? If you're from High court, plz mention your fees for discharge.
Advocate Manish Mishra answered
Since the Session Court has rejected the discharge application, you should file a Criminal Revision Petition directly in the Allahabad High Court to challenge that order.Filing a revision petition in the same Session Court is not an option as they have already passed the final order on your application. You will need a certified copy of the Session Court's rejection order to proceed with the filing in the High Court.Ensure that your petition in the High Court highlights the specific legal errors or missing evidence in the charge sheet that the Session Court may have overlooked.
