Need divorce from husband due to domestic violence with me and son.

I am a Muslim woman married for 18 years. We have 3 kids. For the last 15 years we were staying abroad and are now in Bangalore after my husband's project got over. We are staying in the flat given by my father in our family's three storey building. My husband has always been verbally abusive with me and now has started physically assaulting me and our 15 year old son. I lodged an FIR against him. I have proof as neighbours have heard and seen his behaviour. Now I want to divorce him. Staying in the same house can I file for divorce? My husband is doing business in a nearby office and due to weak financial conditions he is refusing to leave my flat. He sold off all his property to pay his loans. I get a little rental income and together we pay for our expenses.

you can file divorce case if you have sufficient financial resources. you are saying your husband running in loans and you cannot get any maintenance for your self and your children. you may better get financial sources first then go for divorce.
