11-Jul-2025 (In Divorce Law)
My sister got married 1.5 years. Through recent tests we got to know he is infertile( not impotent). His testes are inside the body, his sperm count is zero. Even though he under go operation the chance of having children is very low with high cancer risk. We want the divorce from him we do not whether he is ready for this or not. How we can proceed in this case to get the divorce as early as possible. Till now they did not apply for marriage certificate( Hindu marriage).

hi yes your sister could proceed for divorce on the ground of impotency and that the said fact is disclosed from the date of marriage and then you could file petition in court for that and that it is better to apply for marriage certificate

Under the Hindu Marriage Act your sister can file for divorce on the grounds of husbands in curable infertility proven. Marriage Certificate does not stop her from a divorce. Marriage photos, Wedding card and Witnes statements can prove the marriage in court. if the husband agree's mutual consent divorce is faster. Otherwise you can file a contested divorce citing medical evidence. Consult a lawyer to start the process quickly.
