Need advice to know what should be done in my marital issues

28-Apr-2023 (In Divorce Law)
Hi, Even after 7 years of marriage and a 4 yrs old son, I feel that my wife and I have a lot of issues living together. We come from good families and have not involved them in all this yet. We fight a lot and I feel she is not happy with me and same with me. She thinks about money related things always, and I am totally opposite. Want to know, if I think about taking divorce: 1) will I somehow get the custody of my son? 2) or there is no way I can get the custody of my son? Separation without getting my son is not an option for me. I can’t live without my son. Need suggestions here.

Hello as per your query I would suggest you to file for divorce case either contested or mutual ( if ur wife is ready) . looking at the age of child u will get visitation rights. For more information on this contact me with the registered mobile no with lawrato.

hi, I have just seen your query carefully and minutely. In my opinion according to the Hindu Minority and guardian Act, first the father is the natural guardian then the mother. But upto the age of 5 years of the child the mother is the only preferred natural guardian over the father. Furthermore the court always decides the custody of minor children on the basis of welfare of them after considering various factors. In my opinion you can first file a petition under section 10 of Hindu marriage act for judicial separation in place of divorce. you can call me without any hesitation for further information and advice
