Need advice on how to file a divorce case

My husband and I are married for about 7 years. We got married after knowing each other for 8 years. We have two daughters - elder one is almost 5 years old and the younger one is 2.5 years old. Currently I have no love/ respect/ trust left for him because of the mental and verbal abuse (sometimes physical and from mother in-law as well) I have been facing from the very beginning of the marriage. The huge differences in our point of views are making it hard for a reconciliation. We have been living separately (in the same house) for last about 4.5 months. My husband is not ready for a mutual divorce if I want to get the custody of the kids. But he is ready if I leave the kids in his custody. I really need some urgent help in this regard.

you need to send notices to him or make written conversation how he wants to move out as in this era no one can be trusted on verbal terms , custody of kids would not be an issue , your husband i am sure has discussed a lawyer so has refused to opt for divorce understanding the consequences he has to face

yes you can file for divorce since your husband is not ready for divorce it will be contested divorce and ground of mental harassment and cruelty faced by from your husband as well his mother dont worry you ll get the divorce if grounds are proved right
