First, issue a legal notice to your wife calling upon her to explain the allegations and her conduct. Preserve all available evidence. If no settlement is possible, appropriate divorce proceedings may be initiated on legally sustainable grounds.

If you do not wish to continue the marriage, do not make allegations or take any confrontational steps without legal advice. An extramarital relationship before marriage, by itself, is not adultery under Section 13(1)(i) of the Hindu Marriage Act; adultery must relate to voluntary sexual intercourse after marriage. However, if your consent to marriage was obtained by fraud or concealment of a material fact, annulment under Section 12 may be examined, subject to its strict statutory requirements and limitation. Your photographs and other evidence should be preserved in original form. If there is no valid ground for annulment, divorce on an available statutory ground can be considered.

If you have documentary evidence of your wife’s relationships before marriage, those facts may be relevant depending on the circumstances, but mere suspicion or photographs may not by themselves establish a legal ground for divorce. Since the marriage is only four months old, you should preserve the original photographs, messages and other lawful evidence without hacking accounts or conducting illegal surveillance. You may consider consulting an advocate regarding annulment or divorce, depending on whether there was concealment of a material fact, fraud, or any other legally recognised ground under the personal law applicable to your marriage. If you do not wish to continue the marriage, avoid confrontation or threats and proceed through the proper legal process. If you have decided that you do not want to continue the marriage, do not confront her aggressively or make public allegations about her relationships. Preserve the evidence and take the appropriate matrimonial-law route. Assuming you are governed by the Hindu Marriage Act, 1955, there are two potentially relevant legal routes. 1. First, determine whether the relationship was before or after marriage This distinction is very important. Under Section 13(1)(i) HMA, divorce can be sought where the other spouse, after solemnization of the marriage, has had voluntary sexual intercourse with another person. Therefore, evidence of a relationship before marriage does not, by itself, establish adultery under Section 13(1)(i).
