First tell me your location to determine court jurisdiction and you have to file a petition under under sec 13B and move a first motion before the concerned court . Thereafter you have to wait for 6 months after which you can move second motion and get a divorce

Hi We can file a divorce petition under Hindu marriage act, once it will be filed the court will put up for counselling wherein we can state that we dont want to pursue with the same and can move up for divorce. On approval, the court will take the petition forward and you can be legally separated. Any kids from the marriage?

For mutual divorce or divorce by mutual consent means when the legally wedded husband and wife jointly present a mutual divorce petition before the honourable court without putting forth any allegation against each other. Cooling period can also be waived off.
