Q: Can wife claim litigation expense from husband

Can wife claim litigation expense from her husband?? Like if she files case of 498 or DV or maintenance against her husband then can he also file for litigation expense for those cases?? If she is also earning approx 30k per month…

Advocate Atishaya Kaushal answered
YesAny complainant or defendant can pray for litigation expenses. The maintenance relief given to the wife is also not necessary.A husband can also claim maintenance or monetary benefits. Depending on the grounds filed by the husband, he can also put charges on the wife and get a success and favourable judgment

Q: POA holder sold land but did not inform owner or paid sale proceed

I and my brother, 19 years back, gave registered power of attorney to sell our agriculture land to a local relative. We now learnt that he executed a sale deed in favor of his sons in all cash transaction around 16 years back. But he never informed us about the sale deed even after regular meetings between us. Also, he did not pay the sale proceeds mentioned in the sale deed to me. Could you please advise on – n1. Can I ask the sale deed to be cancelled and seek possession of the agricultural land?n2. Can I get stay on the use of the land i.e. cultivation on it?n3. In case (1) and (2) are not possible. can I get sale proceed mentioned in the sale deed from my POA holder with 8% interest for 16 years?nAlso, please advise high level legal process for the same.

Advocate Atishaya Kaushal answered
HiWould like to see your POA that you made in favour of your brother. How did you get to know that the land is sold? Once we go through the document we will be able to suggest if the deal made is void or valid. Basis on that we can get a stay on the use of land and also the money in favour of you and your brother. Would like to discuss in details on what legal remedies you have.
