But fact was they did not given amount and we did not take single rupee as dowry. How to prove her allegation was false. We do not have proofs like video or images. We can understand the plight you have been facing at the hands of your in laws. The false allegations of dowry being put up by your spouse needs to be specifically denied and rebutted in the reply to the petition. Do engage a lawyer having expertise in matrimonial laws.

If the matter has reached the court then you need to prepare a strong reply/WS to the petition filed by her. The burden of proof lies on her to prove her facts. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Hi. A lot of fake facts are placed in Section 9 cases and you have the right to respond appropriately when you file your written statement. The Court will not believe false facts just because they have been stated in Section 9. Please contact me for further consultations.

it's restitution of conjugal rights case. the person who files a case need to prove his case. you need not prove anything. let her prove you took dowry. if you don't want restitution then you can file divorce and no need to continue this case.
