My wife files fake dowry & DV case against me

30-Jun-2025 (In Divorce Law)
My wife filed fake case of dowry, domestic violence with section 9 and 125 for maintenance. But I submitted proof that she is working lady, so then she withdrew 125 maintenance case. I want to know sir still is there any possibility of monthly maintenance i have to pay on basis of DV case?

Yes, even if the Section 125 CrPC case for maintenance is withdrawn, maintenance can still be claimed under the Domestic Violence (DV) Act under Section 20. However, if you have submitted proof that your wife is earning and financially independent, the court will consider that while deciding maintenance. Maintenance is not automatic—it depends on several factors like income, standard of living, and proof of cruelty. You must contest the DV case on merits and present all evidence to avoid unjust maintenance orders.

yes , she can claim maintenance under the dv act and even re-file the maintenance case which she has withdrawn. You should try to compromise the matter with her and settle for a reasonable amount. If you need help feel free to reach out.

Hi, These are common tactics some women are using to live a lavish life. However, judges without examining the complete facts never allow any maintenance. Hence, all the facts need to be clearly understood before guiding with precise steps. Regards

Who has filed section 9, yes little possibility still remain for maintenance but according to proof you might be in safe zone and you ll have to submit your evidence in DV case and order of 125 crpc case and you have a one remedy which you can use against your wife if you have more evidence
