My son has been married 2 months and within 1 month of marraige his wife left our home with her cousin brother, at that time my son was away for his job. From her brother's home, her parents took her to their home just informing us over call that they are taking her and if we want to talk we will have to see them at their place in their city. Since then my son has tried contacting his wife through different ways & she has blocked him from everywhere. 1 week ago her Lawyer called my son stating that she doesn't want to continue with the marraige & wants mutual separation with terms of no Maintenance and that gifts received by both parties should be returned back to each party. When our Lawyer contacted her lawyer now they are saying that they want Maintenance with mutual separation. We have on call record of her lawyers former statement. What should be possible legal step & does my son's wife qualifies for Maintenance? If yes, how much. Please advice.

you should send her notice for restitution of conjugal right, failing which you will have the right to file divorce and maintenance shall not be allowed the basis of this but the thing is that there is 6 month freezing for divorce even on mutual. For more detail contact me Advocate Ranjeet Sonker

she can file the maintenance suit in the concerned family court she also file many cases against you and your son also because she is wife of your son. The amount of maintinance is depend upon her demand and your son income but its the court descrition power. if both the parties want the mutual divorce then its not so easy because for the mutual divorce the merriage waiting period should be 1 year. in some exceptions both parties file the mutual divorce

dear client as per your query I can only suggest that if amicably there is no chance of being together they should get separated if your son has not filed section 9 do tell him to file that by a detailed petition in which every thing should be discussed as by this the intention of girl will be cleared as only in 2moths marriage you cannot file divorce petition it will be premature for future paid consultation please contact us with your relevant documents.
