My office colleague Ramya got married by last Aug'22. It's a love marriage, but not accepted by Ramy

01-Apr-2023 (In Divorce Law)
My office colleague Ramya got married by last Aug'22. It's a love marriage, but not accepted by Ramya's family. Her spouse family front ended everything and did an arranged marriage, without involvement of Ramya's family. Later only they came to know that. But there seems some clash between Ramya and her spouse just a few days before the marriage and it still continues between them. Her spouse is not taking caring of her and always be idle or silent at their home. Ramya is undergoing a kind of mental abuse and despite of multiple requests, he is not changing his attitude. She is willing to move out of this life as a mutual consent. Their marriage is not registered yet, but marriage invitations and marriage/reception photos are there. In this case, what is the legal process to break this marital life.

Marriage invitation and photo and aadhaar card or any government ID proof is enough for applying mutual consent. But for applying for a mutual consent divorce u need to wait till Aug 2023. One year after marriage only u could apply as per Hindu Marriage act. There after you apply with 13B petition assuming you are Hindu then need to wait for 6 month to file second motion i.e. filing proof affidavit, then u get divorce

Hi whether the marriage is registered or not, the only way to dissolve the marriage is by getting a decree of divorce through a competent court. in your case they have to file a petition for mutual consent divorce and get the things done. for further doubts pls feel free to call me

even the marriage between your friend and her spouse is not registered as per Hindu law the marriage performed as valid before the law so you cannot break the marriage simply the only remedy to put an end to the matrimonial disputed you to get legal divorce in the court of law otherwise and previous marriage will subsist and it will became hurd to your friend in future marriage unless she gets divorce she cannot marry if she does so then it will amounts to bigami and for imprisonment of 7 years is the punishment for bigami I
