My husband wants to get a divorce but I am not ready for it

I am married for one year but we have not registered our marriage, our marriage was done with hindu rituals in the presence of all family members. Even my child was born but he died on the same day, now my husband want to separate even his family is agreed. From last one month i am staying at my parents home, my husband and in-laws are not in touch with me. They have not contacted me from one month. I don't want divorce. Now what should be my step???? As my husband or in-laws have not contacted me? What should I do now? Should I wait for some more time for their step or take some legal action? I want to protect my married life.even i want to know if I am not ready for divorce then my husband can take divorce or else what procedure will be followed by him to get separated??? If i am not ready then things will go in his favour for divorce???

Hello Mam

You can file a divorce petition for cruelty done on you by your husband. Beside this you can also claim maintainance from your husband for your day to day expenditures which will be fixed by court.

Don’t worry there are lot of legal provisions in Indian legal system in your favour. U can wait for his action or u can file petition under section 9 of Hindu marriage act. U are also entitled to get compensation under section 12 domestic violence act and also under section 125 of Crpc. If u want to harass ur husband and in laws u can file complaint under section 498 a of ipc. Don’t worry at all.

as far as divorce is concern it will be tough for your husband unless or until he proved his griund for divorce or you are ready fir mutual divorce. you should not wait any more you may file for restiration of cosugal rught u/s 9 h.m.a .

What is the reason for seeking divorce, you have not mentioned. i would suggest ask your parents or brother to drop you at your husband home. if they do not allow then you should file a petition u/s 9 H.M.A for restitution of conjugal rights.
when you don't want divorce don't wait. if the husband files divorce you will get a notice/ summon from court . upon receiving the summon you must defend the case through lawyer. if there is no valid reason for divorce then no divorce will be granted.

if you do not want divorce just be in touch with them because if you will not do so that will be the mistake on your part. they can take the divorce on a ground that you are not intrested in the relation and you choose to get separated and you can also file a complaint regarding your situation in women cell if they do not accept you. contact for breif.
