My husband wants to divorce me over false grounds despite torturing me

09-Apr-2023 (In Divorce Law)
Hello sir, My husband and his family have not been good to me since my marriage in 2018 because they dint get desired dowry and I belong to a different caste. Now my husband is asking for divorce, as he says that he doesn't want a kid with me because I belong to another caste and when I denied to divorce him then he is saying that he will start living seperately and will prove in court after 2 years that I (myself) dont want to stay with his old parents and based on desertion he will get the one sided divorce. I am not at fault, my in laws always taunt me for dowry whenever I visit them and they themselves said that they dont want me to visit their house. what should I do now. I dont want a divorce at all.

Hello ma'am, I have went through your query and it's really sad to know what you are going through. since you are not willing to get a divorce from your husband you have 2 alternatives that can be filed in your case. one is you can file a case on mental cruelty against your husband and your in-laws and 2 ndly you can file petition for restitution. now before filing a case of cruelty it would be advised to seek help from the women cell on the above matter. but it is also advised to get your complaint for caw cell drafted by an advocate so that each and every instances can be mentioned in detail and in proper manner.

You have a remedy in family laws. Your in laws are bound to have you back. You should immediately move to the court seeking protection.

Demand of dowry or not letting you enter in the house amounts to cruelty and for the same you seek intervention of the court.

Please feel free to reach out for further assistance.

mam if you are living separate frm yiur husband then you will have to file a case of sec 9 restitutiom of conjugal rights then only it will prove that you want to live with your husband as well you dnt want to take divorce
if again and again your family pressurizing you for dowry then various complaints can be filed against them to safe guard u and your future
