My husband is unlivable. I want Divorce from my husband.

I got registered marriage 3.6 years back.it was a love marriage . Me and him not staying together since marriage. He has orally abused me many times. I dont want to stay with him. We both belong to Hindu. How can I divorce him. How long it takes for divorce?

if you have lived apart from last minimum two years you have a ground eligibility for filing for divorce. You have not stated whether your spouse is also willing for the divorce, if so you both can file for mutual petition.

You can send legal notice to your husband by intimating about the separation, if he equally shows the interest to divorce then it is better to go for Mutual Consent Divorce under Section 13-B before Family court. After filing the case there will 6 months period for conciliation if you still stick on to the decision then the divorce will be granted by the court after 6 months period. Contact any advocate at your place who will help you out.

Here you have two option. You can approach the court under mental harassment or mutual divorce. In case of mental harassment you need to prove the allegation. In case if he is also ready to give divorce then, you go for mutual consent.

When you decided to leave separately, ask him to give divorce by mutual consnet. if not please porceed by mental harassment basis

You can file domestic violence against women for abuse and u can also file dowry harassment case for abusing many times since it is love marriage and you can file divorce case against ur husband if he agrees mutual divorce can be taken and it takes 6 months time for divorce or if contested 2 to 3 years

If your husband is also willing to give divorce to you then i suggest you to better file a mutual divorce petition before the Jurisdictional family court i.e., Bangalore. I have suggested this option because you can get the decree of divorce within 7 month(soon after the expiry of 6 months of mandatory waiting period from the date of filing the mutual divorce petition). In case if your husband is not willing to give you a divorce then you need to file a contesting divorce petition which will prolong for few years.
