My husband and I wish to apply for mutual divorce. I had taken transfer from munbia to Pune after marriage. Now I'm working in pune and cannot leave pune until I get transfer. I cannot leave my current place of residence with that of my husband in pune until my divorce is finalized. Can the court accept our petition even when we are living together under one roof. But in reality we are just sharing the flat. It is not a home. I live like a PG I that house because sir lockdown and my workplace being Pune. Plz advise.

In the case for divorce under mutual consent it is required the last place of your residence as your proof and the fact that you are staying separately since last one year which you both need to state in the petition for rest you can call on the number for consultation

Yes you both can file marriage petition under mutual consent. Even if you both are residing currently don't show the same. Show one's address at Mumbai. And show that you both are living separate from more than one year. Court is not going to visit and see. You both will get decree once you both lead evidence affidavit after six months.
