My daughter has filed a divorce petition and in the course of filing the maintenance one. She has one minor son. She intends to claim a one time lump-sum permanent alimony for herself and son. While her husband earns a good salary she is not sure of his net worth. Hence to ease his financial load can she claim a lump-sum alimony on account of her own maintenance as one time settlement and a monthly amount towards her son's maintenance?

First of all sir permanent alimony can only be filed after getting the decree of divorce... moreover if she have filed a maintenance case then she should claim maintenance for herself as well as her son separately under one petition... For more detailed information you need to have a consultation with me. Regards, Subhashis Paul Advocate High Court Calcutta

first of all, which case was registered before? if the maintenance case was registered before the matrimonial suit then is it the single divorce claimed or a mutual divorce one? lastly, in the petition of divorce, what is actually written there is the main thing. without knowing all of this, I am not able to provide any information to you.
